The Israel Ministry of Justice Patent Office oversees trademark affairs, along with patents, geographical indications, and other intellectual property matters. Official languages are Hebrew and Arabic. Trademark rights are acquired through registration or use. Registration is not mandatory, but it is recommended for enhanced protection and renewal purposes. Israel follows a "first-to-use" principle, where long-term and well-known use of unregistered trademarks may aid in rights enforcement.

ⅠTrademark Application


Israel adopts the Nice Classification and allows single applications covering multiple classes. Registrable elements include words, names, logos, numbers, slogans, color combinations, 3D marks, sounds, and scents.

Applicants not residing in Israel must appoint a local agent. Required materials:


  • 1. Trademark specimen;



  • 2. List of goods/services;


  • 3. Applicant's name and address;


  • 4. Power of Attorney;


  • 5. Priority documents (if claimed) with translations.



ⅡThe registration process involves:


Application → Acceptance → Examination → Announcement → Approval → Issuance of Certificate.


After submission, the application undergoes a formal examination by the authorities to ensure that the classification and classification details comply with regulations. This process typically takes about one month. Once accepted, the trademark proceeds to substantive examination, which generally takes around 3 to 5 months and includes a conflict check. If the examination is successful, the trademark is published. If the application fails, a rejection notice will be issued, requiring the applicant to respond within the timeframe specified in the notice.

ⅢTrademark Maintenance

Registered trademarks in Israel are valid for 10 years from the application date. Renewals can be filed within three months prior to the expiration date, with a grace period of six months. Each renewal extends the validity for another 10 years.

Applications for invalidation or cancellation of a trademark can be filed under two provisions of Israel’s Ordinance No. 22362 of 1980:

1. Section 39:

If the trademark violates Sections 7–11 of the Ordinance (e.g., lacks distinctiveness, contravenes public order, or constitutes unfair competition), cancellation must be requested within five years of registration.
If the registration was made in bad faith, cancellation can be requested at any time.

2. Section 41:


If the trademark has not been used in Israel for three consecutive years, any interested party may request cancellation, unless non-use is due to force majeure.
To counter a cancellation request based on “non-use,” the registrant may provide evidence such as:

  • Invoices
  • Packaging and decoration
  • Quotations
  • Product catalogs
  • Advertisements
  • Labels
  • Sales figures
  • Written statements
