Armenia's trademark registration and protection are primarily governed by the following legal documents: the Law of the Republic of Armenia on Trademarks and the Civil Code of the Republic of Armenia. Additionally, Armenia is a member of several international treaties, including the Paris Convention, the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), and the Nice Classification Agreement.

Under Armenian trademark law, a registered trademark may be subject to cancellation if it has not been used for a consecutive period of five years. Third parties can file a request for cancellation on the grounds of non-use. In Armenia, the registration, administration, and cancellation of trademarks are handled by the Intellectual Property Agency of Armenia.

Classification

The 11th Edition of the Nice Classification has been adopted.

Convention Priority

Armenia is a member of the Paris Convention for the Protection of Industrial Property. Priority can be claimed within six months calculated from the filing date in any member country of Paris Convention 

Examination Procedure

After the completion of filing procedure the Official Notification of the receipt of the Application is issued within 2-3 months. Then the trademark undergoes substantive examination for about 6-8 months. On condition that the Trademark meets the requirements of protectability the grant decision is issued. After payment of the registration fee the certificate of registration is issued within 2-3 months. The procedure of the trademark registration takes from 12 to 14 months.

Opposition

The decision of the trademark registration can be opposed by the third parties within 2 months from the date of publication.

Duration and Renewal

The validity of a trademark registration is for 10 years from the application date and renewable for similar periods of 10 years each. The renewal application can be submitted within 1 year before expiry. The trademark law provides for a 6 months period for late renewal of a trademark with penalty.
