The Association of Southeast Asian Nations (ASEAN) comprises ten member states: Singapore, Malaysia, Thailand, Vietnam, Indonesia, the Philippines, Cambodia, Laos, Myanmar, and Brunei. At present, ASEAN has not established a unified regional patent system, and applicants must file patent applications separately in each country. This article summarizes, country by country, key points on patent types, national phase/filing deadlines, and the conversion between invention and utility model application types, for applicants' reference in planning their overseas filing strategy.

1. Singapore

Patent Types: Invention and Industrial Design.

Filing Deadline:

• Paris Convention route: 12 months from the priority date.
• PCT route: 30 months from the priority date.

Inventive Step Examination: Singapore conducts an independent inventive-step examination for invention applications, based on whether the invention would have been non-obvious to a person skilled in the art in light of the prior art.

2. Malaysia

Patent Types: Invention, Utility Model, and Industrial Design.

Filing Deadline:

• Paris Convention route: 12 months from the priority date.
• PCT route: 30 months from the priority date.

Inventive Step Examination: Invention applications undergo inventive-step examination; utility models are not examined for inventive step. Utility models are subject to both formality examination and substantive examination (novelty). Note: a Malaysian utility model must contain exactly one claim, and may not include multiple independent claims or any dependent claims.

Conversion Between Invention and Utility Model Applications: Permitted. Invention and utility model applications may be converted into each other; the request must be filed within 3 months from the issuance date of the examination report. The converted application retains the filing date of the original application.

3. Thailand

Patent Types: Invention, Petty Patent (equivalent to a utility model), and Industrial Design.

Filing Deadline:

• Paris Convention route: 12 months from the priority date.
• PCT route: 30 months from the priority date.

Inventive Step Examination: Invention applications undergo inventive-step examination; petty applications are not required to satisfy the inventive-step requirement but must be novel.

Conversion Between Invention and Utility Model Applications: Permitted. Applicants may convert an invention application into a petty application before grant, and vice versa. The converted application retains the filing date of the original application.

4. Vietnam

Patent Types: Invention, Utility Model, and Industrial Design.

Filing Deadline:

• Paris Convention route: 12 months from the priority date.
• PCT route: 31 months from the priority date.

Inventive Step Examination: Invention applications undergo inventive-step examination; utility models are not required to meet the inventive-step requirement but must be novel.

Conversion Between Invention and Utility Model Applications: Permitted. At any time before the Vietnamese Intellectual Property Office issues a decision to grant or refuse the application, the applicant may request to convert an invention application into a utility model application, and vice versa. The converted application retains the original filing date.

5. Indonesia

Patent Types: Invention, Simple Patent (equivalent to a utility model), and Industrial Design.

Filing Deadline:

• Paris Convention route: 12 months from the priority date.
• PCT route: 31 months from the priority date.

Inventive Step Examination: Invention applications undergo inventive-step examination; simple patent applications are not required to meet the inventive-step requirement but must be novel.

Conversion Between Invention and Utility Model Applications:

Paris Convention route: conversion between invention and simple patent applications may only be requested at the same time as the request for substantive examination. For example, once an application is filed as an invention and a substantive examination opinion is subsequently received, it can no longer be converted into a simple patent application.

PCT route: only the invention type may be selected; a simple patent (utility model) is not available.

6. Philippines

Patent Types: Invention, Utility Model, and Industrial Design.

Filing Deadline:

• Paris Convention route: 12 months from the priority date.
• PCT route: 30 months from the priority date.

Inventive Step Examination: Invention applications undergo inventive-step examination; utility models are not required to meet the inventive-step requirement but must be novel.

Conversion Between Invention and Utility Model Applications: Permitted. An invention application may be converted into a utility model application (and vice versa) at any time before the application is granted or refused. The converted application retains the filing date of the original application.

7. Cambodia

Patent Types: Invention, Utility Model, and Industrial Design.

Filing Deadline:

• Paris Convention route: 12 months from the priority date.
• PCT route: 30 months from the priority date.

Inventive Step Examination: Invention applications undergo inventive-step examination; utility models are not required to meet the inventive-step requirement but must be novel. Note: the Cambodian patent office, in most cases, lacks the infrastructure to conduct substantive examination on its own, and instead relies on the examination results of foreign patent offices (such as USPTO, EPO, JPO, CNIPA, KIPO, IPOS, etc.). Applicants may submit information on favorable outcomes from corresponding foreign applications to simplify prosecution and reduce costs.

Conversion Between Invention and Utility Model Applications: Permitted. At any time before the Cambodian Department of Intellectual Property issues a decision to grant or refuse the application, the applicant may convert an invention application into a utility model application, and vice versa. The converted application retains the filing date of the original application.

8. Laos

Patent Types: Invention, Petty Patent (equivalent to a utility model), and Industrial Design.

Filing Deadline:

• Paris Convention route: 12 months from the priority date.
• PCT route: 31 months from the priority date.

Inventive Step Examination: Invention applications undergo inventive-step examination; petty patent applications are not required to meet the inventive-step requirement but must be novel. Note: similar to Cambodia, information on favorable outcomes from corresponding foreign applications may be submitted to obtain patent grant in Laos, simplifying prosecution and reducing costs.

Conversion Between Invention and Utility Model Applications: Permitted. The applicant may request conversion at any time before the invention application is granted or finally refused. The converted application retains the filing date of the original application.

9. Myanmar

Patent Types: Invention, Utility Model, and Industrial Design.

Filing Deadline:

• Myanmar is currently neither a PCT member state nor a Paris Convention member state.
• Under Myanmar's Patent Law, applicants may claim priority based on an application first filed in any World Trade Organization (WTO) member state, within a 12-month priority period.

Inventive Step Examination: Invention applications undergo inventive-step examination; utility models are not required to meet the inventive-step requirement but must be novel.

Conversion Between Invention and Utility Model Applications: Permitted. The publicly available implementing regulations have not yet specified a definite time window for requesting conversion; this will be supplemented once confirmed.

10. Brunei

Patent Types: Invention and Industrial Design.

Filing Deadline:

• Paris Convention route: 12 months from the priority date.
• PCT route: 30 months from the priority date.

Inventive Step Examination: An independent inventive-step examination is conducted for invention applications.

Practical Recommendations:

1. Choice of Patent Type: For countries with a utility model system, applicants must choose, at the time of first filing, whether to file as an invention or a utility model. However, most countries (except Indonesia) allow conversion from an invention to a utility model during subsequent examination, providing an important fallback when the outlook for the inventive-step examination is unfavorable.

Indonesia expressly provides that a PCT-route application cannot be converted into a simple patent, and that under the Paris Convention route, a conversion of application type may only be requested at the same time as filing the request for substantive examination. Applicants planning to file in Indonesia should therefore choose the application type carefully from the outset.

2. Accelerated Examination: Applicants may take advantage of the Patent Prosecution Highway (PPH) or the ASEAN Patent Examination Cooperation (ASPEC) program to speed up examination. Singapore, Indonesia, Thailand, Vietnam, Malaysia, the Philippines, and other countries have joined these programs.

3. Language Requirements: Brunei, Malaysia, the Philippines, and Singapore accept applications filed in English; Cambodia, Indonesia, Laos, Myanmar, Thailand, and Vietnam require translation into the local language. Vietnam in particular requires a Vietnamese translation to be submitted at the time of filing. Cambodia, Indonesia, Laos, and Thailand, however, all allow the English-language application documents to be filed first, with a translation into the local language submitted within a prescribed deadline thereafter.
