In a series of complex and large-scale patent infringement lawsuits, a patent holder initiated over 30 infringement actions against our client across various jurisdictions in China, imposing significant pressure and uncertainty. Inconsistent rulings from different local courts could have had a severe impact on our client’s business operations.
Jurisdictional Challenge
After identifying the risks posed by fragmented litigation and immediately filed jurisdictional objections, Chang Tsi’s legal team successfully persuaded the Supreme People’s Court to consolidate all cases under the jurisdiction of the Nanjing Intermediate People’s Court through legal advocacy. This move not only prevented inconsistent rulings from multiple courts but also enabled us to centralize resources and streamline our litigation strategy.
Patent Invalidation Requests
Facing strong pressure from the patent holder and a high risk of infringement by our client’s products, we conducted in-depth research on the asserted patents, located relevant prior art, and filed invalidation requests against all involved patents. Thanks to thorough preparation and persuasive arguments, we succeeded in invalidating several overly broad claims. Notably, the adjudication panel recognized our favorable interpretation of key technical features, laying a solid foundation for the subsequent non-infringement defense.
Non-Infringement Defense
Based on the interpretation of critical technical features in the Patent Reexamination Decision, we mounted a strong non-infringement defense. The court ultimately adopted our arguments, ruling that none of the client’s products infringed the asserted patents, thus safeguarding our client’s major product lines from legal disruption.
This series of cases demonstrates Chang Tsi & Partners’ strategic expertise, deep legal acumen, and strong capabilities in managing large-scale patent litigation.
First, by raising jurisdictional objections, we effectively avoided the risks associated with inconsistent rulings from multiple courts and ensured centralized case handling. This step not only saved time and resources but also reduced legal risks, paving the way for more effective case management.
Next, we strategically used the patent invalidation process to narrow the scope of protection. Through detailed analysis of prior art, we successfully invalidated claims that were overly broad, reducing the infringement risk for our client’s products and providing strong support for the non-infringement argument. Our success in the invalidation process highlighted our deep understanding and skillful application of patent law.
Building on this, we developed and implemented a non-infringement strategy that leveraged the results of the invalidation proceedings. We precisely interpreted the key technical features and applied them in our defense. The court ultimately accepted our position, ruling that all of our client’s products were non-infringing. This result ensured the legality and market position of the client’s products and eliminated significant legal risks.
The comprehensive victory across all cases underscores the exceptional legal expertise, strategic insight, and perseverance of the Chang Tsi legal team in navigating complex legal disputes. These achievements were made possible by the team’s tireless efforts and unwavering commitment to protecting the client’s interests. Through this litigation, we not only resolved a major legal crisis but also reinforced the client’s competitive edge in the marketplace.
Chang Tsi & Partners remains committed to professionalism and dedication, always putting clients first and striving for excellence in every case. This complete legal victory once again affirms our outstanding capabilities and leadership in the field of patent litigation.
The appeals in this series of cases have been accepted by the Supreme People's Court and are scheduled to be heard in July 2025.
