The renewal of Brunei trademarks is a key process to maintain the continuous validity of trademark exclusive rights. In accordance with the official regulations of the Brunei Intellectual Property Office (BruIPO) and its relevant norms for trademark management, this article details the core system, application requirements, fee standards and relevant precautions for Brunei trademark renewal, providing comprehensive and operable guidance for trademark owners.

I. Basic Core System of Renewal

After a Brunei trademark is registered and approved, the term of its exclusive right is calculated from the filing date, with a duration of 10 years. The trademark owner may extend the trademark protection period infinitely by going through the renewal procedures before the expiration of the validity period. The protection period after each renewal is still 10 years, and the protection scope of the trademark exclusive right after renewal is consistent with the original registration scope.

II. Provisions on Renewal Periods

Brunei trademark renewal is divided into three stages: normal renewal period, grace period and right restoration period. The requirements for each stage are clear, and failure to process on time will lead to the loss of trademark exclusive rights:

1. Renewal Window Opens: 6 months before the expiration of the trademark validity period. No additional fees are required for renewal during this period, and the process is the simplest.

2. Grace Period: Within 6 months after the expiration of the trademark validity period. Renewal can still be handled during this period, but an additional late fee must be paid.

3. Right Restoration Period: If renewal is not handled after the expiration of the grace period, the trademark owner may apply to restore the trademark exclusive right within 6 months after the end of the grace period to avoid the trademark being cancelled.

III. Requirements for Application Documents

The application documents for Brunei trademark renewal are simple: Scanned copy of the signed POA. Without complicated notarization or authentication procedures. 

IV. Official Fee Standards (Currency: Brunei Dollar BND)

Brunei trademark renewal adopts the principle of charging per trademark, the official fee is irrelevant to the number of trademark registration classes. The specific standards are as follows:

• Official Fee for Normal Renewal: 200 Brunei Dollars per trademark (1 BND ≈ 5.3 CNY).

• Late Fee for Grace Period: 150 Brunei Dollars per trademark, which shall be paid together with the official fee for normal renewal.

V. Renewal Approval and Certificate Issuance

After the renewal application is submitted, the Brunei Intellectual Property Office (BruIPO) will review the completeness of the application documents and the payment of fees. After approval, the official will issue a paper renewal approval certificate to the right holder. This certificate is a legal document proving the continuous validity of the trademark exclusive right.

VI. Important Notes

1. Brunei trademarks adopt the principle of "first-to-file + use protection". Even if the renewal is handled, if the trademark is not actually used in Brunei for 5 consecutive years without justifiable reasons, any third party may apply to the court to cancel the trademark. Therefore, the owner shall continue to retain use evidence (such as sales contracts, invoices, advertising materials, etc.) before and after renewal.

2. The relevant renewal periods (normal renewal period, grace period, right restoration period) are strictly fixed and cannot be extended. It is recommended that the right holder make early plans and complete the renewal during the normal renewal period to avoid additional late fees or loss of trademark rights.
