Chang Tsi & Partner Won A Civil Litigation Against a Furniture Company and Its Affiliated Company

In mid March, Chang Tsi & Partner got a great news. Frank Liu and Tracy Shen, representing a new American client, won a civil litigation against a furniture company and its affiliated company. In this case, the defendant previously is our Client’s distributor and after the termination of the distribution relationship, the defendant continued its use of our Client’s trademarks in their business operation to sale their own products, and the defendant also registered a domain and the other defendant using our Client’s trademark as main part of the domain name and company name.

We conducted a series of notarizations against the target and its affiliated companies, including on-site notarization, notarized purchase and phone notarization to preserve infringing evidence. We filed the infringement and unfair competition litigation on Sept.22, 2013 with Tianjin Binghai New District Court.

Due to our efforts, on Feb.26, 2014, Tianjin Binghai New District Court issued the judgment that the defendants were guilty of infringement and unfair competition. The judgment ordered defendants to cease the infringement and unfair competition, pay a compensation of 200,000 RMB. The judgment will take into effect if no appeal is filed in the given time.

The above case is the first business contract and IP litigation since this  American client expanded their market to China.
