On April 29, the State Administration for Market Regulation announced the Top Ten Intellectual Property Enforcement Cases of 2024. The “LEGO” trademark infringement case handled by Chang Tsi & Partners was successfully selected. In addition, this case also selected as Typical Cases of Administrative Protection of Intellectual Property Rights in Beijing for the Year 2024 by Beijing Municipal Intellectual Property Office.
In May 2024, the Beijing Municipal Market Regulation Bureau received a tip-off from LEGO Juris A/S, alleging that a local consulting company was involved in activities infringing on the exclusive rights of a registered trademark. During an on-site inspection of the company's business premises, it is found that the company primarily engaged in education and training services, which were identical to the service categories approved under LEGO Juris A/S's trademark. Moreover, the company had used "LEGO" and "乐高" (the Chinese transliteration of LEGO) trademark logos on its signage, classroom doorplates, promotional posters, and reception desk, but was unable to provide legal authorization documents for the use of these trademarks. Law enforcement officers conducted inquiries with the company's responsible personnel, who admitted to the use of the relevant trademarks. Additionally, after a detailed analysis of the company's business data, the Bureau determined that the illegal business revenue amounted to a total of 3.5138 million yuan.
After investigation, it was found that the local company used a trademark identical to the registered "LEGO" trademark on the same type of goods without the permission of the trademark registrant. This act clearly violates Article 57 of the Trademark Law of the People's Republic of China, constitutes an infringement of the exclusive rights of the registered trademark, and suspected of criminal activity. The Beijing Municipal Market Supervision Bureau has transferred the case to the judicial authorities for further handling.
