The Beijing Trademark Association recently announced its selection of the Top Ten Litigation and Top Ten Non-Litigation Typical Cases for 2025. Chang Tsi & Partners' representation of HBI in its case against a Fujian family business for counterfeit "Champion" trademark infringement was selected as a 2025 Typical Civil Litigation Case. Additionally, the "Apollo" trademark opposition case was selected as a 2025 Typical Non-Litigation Case at the Trademark Office stage.

HBI v. Fujian Family Business Counterfeit "Champion" Trademark Infringement

This case represents a successful precedent in combating trademark counterfeiting and unfair competition. The court not only fully supported the plaintiff's damages claim, including double punitive damages, but also, through effective legal strategy, named the core controlling individual as a defendant, successfully preserved his assets, and persuaded the court to hold him jointly and severally liable. This outcome has significant practical implications for stopping infringement at its source, ensuring that liability is not only reflected in the judgment but also enforceable in practice. The court's fair ruling reinforces the confidence of foreign brand owners in enforcing their IP rights in China and contributes to a better business environment at the judicial level.

"Apollo" Trademark Opposition

This case, also selected as one of the China National Intellectual Property Administration's Top Ten Typical Cases of the year, is a leading example of applying Article 30 of the Trademark Law to protect the innovations of a leading company in the intelligent driving industry. The CNIPA noted in its commentary that "the case effectively protects the innovations of a leading enterprise in the intelligent driving sector and provides a useful reference for IP protection in emerging technology fields."

The selection of these two cases as Beijing Trademark Association 2025 Typical Cases not only affirms Chang Tsi & Partners' professional capability and practical experience but also reflects the team's precise understanding and strategic application of legal rules in complex trademark disputes. Looking ahead, Chang Tsi will continue to deepen its practice in intellectual property legal services, continuously enhance service quality and professional depth, provide clients with more systematic and effective IP solutions, and contribute valuable experience to industry practice and the development of legal standards.
