Successfully persuade the court to apply punitive damages, effectively stop the infringement, and obtain a damages award of RMB 4.82 million. Assist the client in coordinating multi-jurisdictional administrative raid actions to crack down on counterfeit stores, seize over 1,700 counterfeit items and secure cumulative fines of nearly RMB 1 million.
• Represent a world-famous chain restaurant giant in China in a trademark infringement lawsuit against a Beijing company and a Hong Kong entity, and initiate trademark invalidation proceedings. Effectively demonstrate to the court the necessity of well-known trademark recognition, the scale of infringement, and the substantial illicit profits involved. By combining administrative and civil litigation strategies, successfully halt infringement by over 400 counterfeit stores nationwide, secure the recognition of the client’s trademark as well-known, and obtain a damages award of RMB 3.3 million.
• Represent a leading global human resources company in a trademark infringement and unfair competition lawsuit against a Nanjing enterprise. Fully reveal multiple forms of infringement and malicious conduct by the defendant. After first and second instance proceedings, effectively stop the infringement and obtain a damages award of RMB 1 million.
• Represent a globally renowned packaging equipment brand in a second-instance civil lawsuit concerning trademark infringement and unfair competition against a Jiangsu enterprise. Successfully stop the infringement and obtain a final damages award of nearly RMB 1.5 million.
• Represent a global fashion brand in multiple intellectual property infringement lawsuits, successfully defend against the plaintiffs’ claims and achieve dismissal of infringement claims for times.
• Represent a famous U.S. beauty and medical equipment and service provider over the course of four years in trademark invalidation and non-use cancellation actions, remove more than ten maliciously registered trademarks. After clearing all prior obstacles, assist the client’s main brand in securing registration in core classes, lay the foundation for client’s commercial deployment and brand operations in China.
• Represent a world-famous chain restaurant giant in trademark invalidation proceedings. By invoking the “extended protection” of well-known trademarks and applying the proper legal interpretation method, successfully overcome the five-year limitation for relative grounds, obtain well-known trademark protection for the client’s mark, invalidate the squatter’s trademark, and further strengthen the brand’s value.
• Handle multiple transactions involving the purchase and transfer of core brand trademarks, with a total transaction value of nearly RMB 6 million.
• Represent various clients in dozens of administrative lawsuits, mostly obtain favorable judgments and achieve recognition of clients’ trademarks as well-known for times.
