Upon receiving notice of such a cancellation request, the registrant must submit evidence of use — or a legitimate reason for non-use — within a strict, non-extendable deadline of 2 months from receipt, with no statutory grace period.
Once notified, the registrant has two months from receipt to submit evidence of use or proper reasons for non-use. The deadline cannot be extended, and there is no statutory window for supplementing evidence later. Commonly accepted evidence includes sales contracts and matching invoices bearing the mark, physical products and packaging, advertising records placed through legitimate channels, and transaction records from e-commerce platform backends.
The mark alone, internal paperwork alone, or a license agreement unsupported by actual use will generally not sustain the registration. Proper reasons for non-use are usually limited to objective obstacles beyond the registrant's control.
