3DHISTECH KFT. has always regarded the protection of its intellectual property rights in China as a cornerstone of its business operations and a fundamental safeguard for the legitimate interests of its partners and customers. In response to the infringement and unfair competition carried out by Jinan Danjier Electronics Co., Ltd. (hereafter referred as “Jinan Danjier”), a former distributor, 3DHISTECH KFT. has taken a series of resolute legal actions. In April 2026, the Jinan Intermediate People’s Court issued a first-instance civil judgment in the dispute over copyright infringement and unfair competition, represented by Tracy Shen and Young Ma, which has now become effective. This judgment reaffirms 3DHISTECH KFT.’s intellectual property rights in China and its unwavering determination to protect them.
3DHISTECH KFT. is the first digital pathology manufacturer in Europe and one of the global market leaders in the digital pathology field. Its 3DHISTECH brand products have won numerous international/domestic awards in the industry. 3DHISTECH KFT. created and publicly published the "3DHISTECH and design (image showed below) " series of works and enjoys copyright in such works. In addition, 3DHISTECH KFT. holds trade name rights, product name rights in "3DHISTECH" and has long held the <3dhistech.com> domain name. After more than twenty years of use and promotion, the above-mentioned identifiers have accumulated significant recognition and commercial value in the digital pathology field.
Jinan Danjier was once 3DHISTECH KFT.’s exclusive distributor in China. The exclusive distribution relationship between the parties terminated in September 2022. Thereafter, 3DHISTECH KFT. gradually ceased supplying finished products and spare parts to Jinan Danjier, and all business dealings between the parties have ceased.
Regrettably, after the termination of the cooperative relationship, Jinan Danjier, without authorization, continued to use 3DHISTECH KFT.’s intellectual property on its website, WeChat and other platforms, continuing to promote and sell 3DHISTECH brand products and obtain illegal benefits. More egregiously, during the cooperation period, Jinan Danjier Electronics, without authorization, squatted certain trademarks and domain names related to the 3DHISTECH brand, and abused such squatted trademarks to send cease-and-desist letters to 3DHISTECH KFT.’s current authorized distributor, sub-distributors and end customers, and filed trademark infringement lawsuit in bad faith, seriously hindering 3DHISTECH KFT.’s normal business operations. In view of this, ChangTsi team represents 3DHISTECH KFT. And filed a lawsuit against Jinan Danjier for copyright infringement and unfair competition. The case has now been concluded, and the first-instance judgment has become effective.
In April 2026, with rounds of communication by ChangTsi team on key disputes, long history and complex facts of the case, after a comprehensive trial, the Jinan Intermediate People’s Court issued a first-instance civil judgment, confirming the following facts:
1. Confirmation of Plaintiff’s Prior Rights: The court held that 3DHISTECH KFT. enjoys copyright in the "3DHISTECH and design" artwork and holds prior trade name and product name rights in "3DHISTECH". The "3DHISTECH" identifier has gained significant recognition and influence in China.
2. Finding of Copyright Infringement by Jinan Danjier: The court held that Jinan Danjier's continued use of identifiers identical or similar to the "3DHISTECH and design" after termination of the cooperation infringed upon the information network dissemination rights enjoyed by 3DHISTECH KFT..
3. Finding of Unfair Competition: The court held that Jinan Danjier engaged in acts of confusion prohibited by the Anti-Unfair Competition Law of the People's Republic of China, i.e. record and continuing use of domain 3dhistech.cn, combined use of its own trademarks with "3DHISTECH" (as showed below), claim of providing services including 3DHISTECH digital pathology applications after the termination of cooperation, etc. causing the relevant public to mistakenly believe that an agency relationship still exists between it and the plaintiff.
Ultimately, the court ordered Jinan Danjier to immediately cease its copyright infringement, including ceasing the use of the "3DHISTECH and design" or similar identifiers, and immediately cease its unfair competition acts, including ceasing the use of "3dhistech" or "3DHISTECH", and ceasing use of the domain including 3dhistech.
The judgment has now become effective. Screenshots of the judgment is attached below.
This judgment further establishes 3DHISTECH KFT.’s rights and clarifies the true ownership of the 3DHISTECH brand in the Chinese market. 3DHISTECH KFT. hereby issues the following formal notice to all existing and potential customers, sub-distributors, and business partners:
Jinan Danjier is no longer an authorized distributor of 3DHISTECH KFT. The exclusive distribution relationship between the parties terminated in September 2022, and all business dealings have since ceased. By court order, Jinan Danjier has no authority to promote or sell 3DHISTECH brand products, represent 3DHISTECH KFT. in any capacity, or use any of 3DHISTECH KFT.’s intellectual property for commercial activities, including but not limited to the "3DHISTECH and design" or "3DHISTECH".
3DHISTECH KFT.'s sole official authorized distributor in China is: Epredia Laboratory Equipment Manufacturing (Shanghai) Co., Ltd. To ensure that you receive genuine 3DHISTECH products and benefit from full after-sales service and technical support, all partners, sub-distributors, and end customers are encouraged to purchase exclusively through this authorized channel. Purchases made through unauthorized sources may result in product quality risks, void warranties, and potential legal liability.
This judgment is a decisive affirmation of 3DHISTECH KFT.’s intellectual property rights in China and a clear market signal: the 3DHISTECH brand belongs to 3DHISTECH KFT., and any unauthorized use will be met with resolute legal action. 3DHISTECH KFT. will continue to monitor the market, pursue all available legal remedies against infringement, and work closely with judicial authorities, administrative enforcement bodies, and professional legal teams to maintain the integrity of its brand and protect the legitimate interests of its authorized partners and customers. The enforcement effort does not end here — 3DHISTECH KFT. remains committed to further actions as necessary to fully restore market order.
